Terms of Service

These Terms govern your use of ShouldaSaid (the "Service"), operated by Ahmed Taweel, trading as Klarschritt, Irmtraud-Morgner-Str. 11, 10318 Berlin, Germany ("we", "us"). By using the Service you agree to these Terms.

1. Eligibility

You must be 13 years or older, or the minimum age of digital consent in your country if higher, to use the Service.

2. What the Service Is

ShouldaSaid is a casual entertainment game: you describe a debate scenario, argue three rounds against an AI or pre-written opponent, and get a score. Opponent responses and scoring (including results, badges, and Aura) are for entertainment only — none of it is factual adjudication of any real-world dispute, and no result should be relied on as advice of any kind.

3. Accounts

You can play anonymously. If you choose to log in via emailed Magic Link, you're responsible for keeping access to that email account secure. We use that login only to save your progress and attribute leaderboard entries to you.

4. Aura, Sparks, and Virtual Items

"Aura" (score) and "Sparks" (play credits) are virtual items with no real-world monetary value. They are non-transferable, cannot be exchanged for cash, and may be reset, rebalanced, or discontinued at any time. Where purchases of Sparks or a subscription are offered, you are buying a limited, revocable license to use them within the Service — not purchasing property — and purchases are non-refundable except where required by law.

5. Acceptable Use

Don't submit illegal content, harassment, hate speech, or anything you don't have the right to post. Debate scenarios and arguments you type may be shown to other users (e.g. on shared result cards) and are processed by third-party AI providers to generate opponent responses (see our Privacy Policy). We can suspend or terminate access for abuse, including attempts to exploit the scoring, Sparks, or referral systems.

6. Your Content

You keep ownership of the scenario and argument text you submit, but you grant us a license to store, process, and display it as part of operating the Service (e.g. judging your argument, showing it on a results screen or downloadable share card).

7. Third-Party Services

The Service relies on third parties: Supabase (data storage and login), OpenAI (AI-generated opponent responses), GameDistribution (rewarded video ads), and Resend (login emails). Your use of features backed by these providers is also subject to their own terms.

8. Disclaimer & Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Ahmed Taweel (Klarschritt) is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, and total liability for any claim is capped at the amount you paid us in the past 12 months (or $0 if you haven't paid us anything).

9. Changes

We may update these Terms. Continued use after a change means you accept the new Terms.

10. Governing Law

These Terms are governed by the laws of Germany, without regard to conflict-of-law rules.
